BOOKING CONTRACT

1. The client shall reimburse the photographer for any additional costs the photographer may incur including, but not limited to parking or event tickets which are necessary to the performance of the services as stated above.

2. If the photographer fails to appear at the place and time specified above without informing the client at least 24 hours in advance, any deposits for payments made shall be refunded to the client.

3. Select proof/edited photographs shall be delivered to the client within one week of the completion of the photo session via a digital method specified by
the photographer.

4. Payment of the booking deposit shall be made at the time of booking. Additionally payment or donation of money to the photographer shall be made at the time of the photo session event.

5. If the client cancels or fails to appear at the place and time specified above without informing the photographer at least 24 hours in advance, any deposits or payments made shall be forfeited. If the client informs the photographer of a cancellation within the specified time period, they may reschedule one time without an additional booking deposit. Additionally rescheduling may result in additional booking deposits.

6. The client shall assist and cooperate with the photographer in obtaining the desired photographs including but not limited to specifying persons and or scenes to be photographed, taking time to pose for the photographs at the photographer's direction, proving a person to guide the photographer to desired persons and/or scenes, pre-shoot consultations, etc. The photographer shall not be responsible for photographs not taken as a result of the client’s failure to provide reasonable assistance or cooperation.

7. The photographer retains copyright and ownership for all the digital images, and hereby grants the client unlimited but not exclusive rights to use or reproduce the photographs for which the client pays.

8. If weather disrupts the photo session, the client must contact the photographer within 24 hours after the event to reschedule, or they will forfeit any monies paid to the photographer.

MODEL  RELEASE & LIABILITY  WAIVER

I hereby assign full copyright of the images to the photographer.  I hereby irrevocably authorize Steven Burnes to use photographs taken of me, my family, and/or my property and authorize assignees, licensees, legal representatives, and transferees to use and publish (with or without my name, company name or with a fictitious name) photographs/images herein described in any and all forms and media in all manners including composite images or distorted representations, for the purpose of publicity, illustration, commercial art, advertising, publishing (including online or print), for any product or services, or other lawful uses as may be determined by Steven Burnes Photography.  I further waive any rights to review/approve any uses of the images, any written copy or finished project.  I have read and understand the terms of this release. 

ASSUMPTION OF THE RISKS AND RELEASE: I understand that there is or maybe an inherent risk associated with the activity of taking photography, posing, and use of photographic equipment and session locations. The client and/or model acknowledges and understands these risks and agrees to not hold the photographer or his assistants liable for instances related to any risks associated with the session or location of the session.

INDEMNIFICATION: I agree to indemnify and defend the photographer against all claims, medical fees, judgements, legal fees, and litigation costs that may arise from the result of our photo session.

DURESS: I acknowledge that I am under no duress to sign this liability waiver and have been given ample time to review before signing.  I agree to forfeit any fees paid to the photographer if I do not agree to sign this waiver.

I HAVE READ THIS DOCUMENT IN FULL AND UNDERSTAND THE CONTENTS THERE WITHIN. I FURTHER RECOGNIZE THAT BY RESPONDING “I AGREE” ON THE BOOKING CALENDAR TO THIS CONTRACT & RELEASE, I VOLUNTARILY SURRENDER CERTAIN LEGAL RIGHTS.
